How to Become an International Student in Australia

The first step to become an international student in Australia is to be granted a student visa.

The education industry is a leading sector in the Australian economy and has many stakeholders who interact on a daily basis with international students to organise, process and finalise the different stages of a student’s visa application.

The major actors in this process are Education Agents, the Marketing/Admissions Department in Australian accredited schools, and Migration Agents. Due to the close relationships among these actors, it can at times be confusing for students to understand the boundaries of each of these actors’ responsibilities and duties. It is therefore vital for students to understand the nature of the relationships among these three service providers and to know what each of them actually does. This knowledge will help students avoid incurring mistakes that may jeopardise the success of a visa application.

Following is a brief outline of the roles of each of these three main actors:

Education Agents

Education agents are often the first contact for international students inside or outside of Australia. The main job of these agents is to understand and meet their clients’ education needs through the wide network of reliable Australian schools that they partner with. Education Agents must have an official training and be approved by the Australian government to be able to work lawfully in this field. Once the study path of the prospective student is clear, Education Agents contact the selected appropriate school and provide them with all the relevant information to enrol the foreign student.

Understandably, students tend to rely on Education Agents for any sort of decision concerning their course of studies, if not also about many other aspects of their life in Australia. Students should remember that as much as the relationship between Education Agents and students is very close by nature, the student should always keep in mind that this is also a business relationship, with economic interests involved.

Accredited Schools in Australia

We are now at the stage where a school comes onboard. To be able to enrol international students, Australian schools must be registered by the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). This is a long and meticulous registration process, but it is necessary to guarantee to all students who choose to study in this country that Australian schools deliver up-to-standard and compliant courses.

It is extremely important that the selected school receives all the current and valid student information from the Education Agent so it can issue a Confirmation of Enrolment (COE), which a student needs to apply for a student visa.

Students should always have a copy of their COE, a copy of the Offer Letter they have signed, and last but not least, a copy of their Australian visa.

All the papers issued by a school are recorded on a platform that is accessible by the Australian Department of Immigration, which approves and grants the actual student visa. Being a very transparent system, the school’s work must be accurate and true because the Australian Government regularly audits schools’ compliance with the many relevant laws and regulations.

Migration Agents

Students should keep in mind that Education Agents are most often not Migration Agents.

The vast majority of Education Agents are not registered by MARA, the Migration Agents Registration Authority. More commonly, Education Agents partner with an independent registered migration agency. But in some unfortunate cases, unprofessional Education Agents can persuade students to believe that they are accredited Migration Agents, leading them to gamble on the chances of their visa being granted.

All students should carefully check the registration and reviews of any vendors they are considering using.

The role of the Migration Agent (or lawyer) is to fill in the appropriate Department of Immigration forms and to submit these while keeping the student and Education Agent informed about the progress of the application. It is the responsibility of the Education Agent and the student to give the Migration Agent, in a timely way, all the exact information that they need to make a truthful submission.

Important Recommendations For Students

The Immigration Department has recently been monitoring Education Agencies more tightly. In the near future, there is a chance that Education Agents may be more accountable for the advice and service that they give, especially if they have put their clients’ visas at risk because of their own negligence.

The best and simplest piece of advice for international students is to always understand what you are agreeing to, signing, and paying for. It is wise to keep a paper or digital record of all discussions, receipts, and documents, and to be on guard for any information that is unclear or inaccurate. There are many good schools, Education Agents and Migration Agents in Australia but students have to research them thoughtfully to find the best ones.

Historical Background of Sri Lankans Coming to Australia

The Australian Department of Home Affairs reports that “In the late nineteenth century, the first Sri Lankan immigrants to Australia were recruited to work on the cane plantations of northern Queensland. There are also reports of Sri Lankans working in goldfields in New South Wales and Victoria, and as pearlers in Broome, north-western Australia. By 1901, there were 609 Sri Lanka born people recorded in Australia.”

The Department webpage continues about later waves of Sri Lankans coming to Australia:

“Following Sri Lanka’s independence in 1948 and the introduction of the Sinhala Only Act…which mandated Sinhalese as the only official language replacing English, many Tamils and Burghers (of mixed European descent) felt disenfranchised. This resulted in significant numbers migrating to other countries including Australia. During the 1960s, Burghers comprised the largest proportion of Sri Lankan migrants to Australia.

“In the late 1960s and early 1970s following the easing of Australia’s migration policies, Asian migrants, including Sri Lankans, were admitted to Australia. Sri Lankan migrants at this time included Tamils, Sinhalese, as well as Burghers.”

The article concludes: “In the following decades, the number of Sri Lankans entering Australia increased. Many who fled the conflict in Sri Lanka between Tamil separatists and Sinhalese arrived as humanitarian entrants. Additionally, there was also significant migration of Sri Lankans under the Skilled and Family migration programs.” Source: The Department of Home Affairs.

Sri Lankans in Australia Today

The Department of Home Affairs also reports that “The latest Census in 2016 recorded 109,849 Sri Lanka-born people in Australia, an increase of 27.1 per cent from the 2011 Census.

“The 2016 distribution by State and Territory showed Victoria had the largest number with 55,830 followed by New South Wales (28,732), Queensland (9,752) and Western Australia (7,796).

The History of Sri Lankans in Victoria

Museums Victoria reports that “Sri Lankans…have been settling in Victoria since the 19th century. They were first counted in the 1871 census, when 58 people were recorded. Like Sri Lankan settlers elsewhere in Australia, they probably immigrated as labourers or gold prospectors.

“The community in Victoria remained small well into the 20th century, with 130 recorded in 1933. Most were Burghers (descendants of European colonisers) – under the White Australia Policy, only those of European descent were welcomed.

“The community began to increase after World War II…By 1966, the Sri Lankan community in Victoria had risen to 3,126, most of them Burghers. The end of the White Australia Policy in 1973 saw increasing numbers of Sinhalese and Tamil settlers in Victoria. By 1976, 9,061 Victorians were of Sri Lankan birth.

“Ethnic conflict in Sri Lanka in 1983 resulted in a significant intake of immigrants under the Special Humanitarian Program. Subsequently, Sri Lanka-born arrivals have come here under the Family Reunion Program, or as Skilled or Independent immigrants.

“Today, Sri Lankans make up the eighth largest immigrant group in Victoria, with 55,835 people recorded in the 2016 census.” Read more at Museums Victoria.

The Popularity of the Australian GTI Visa

The Global Talent Independent visa program (GTI) is off to a roaring success. ZDNet reports that “The Department of Home Affairs has revealed that individuals from the tech sector made up the biggest cohort of those who were granted visas through the Global Talent Independent (GTI) visa program from July 1 to December 31 last year.

“During that six-month period, there were 11,013 visas granted to those who worked in the quantum information, advanced digital data, data science, and IT fields.

“Those in the medtech industry made up the next largest cohort, followed by energy and mining technology, agtech, space and advanced manufacturing, fintech, and cybersecurity.”

The Global Talent Independent Program Visa

The Department of Home Affairs notes that “The Global Talent Visa Program, also known as the Global Talent Independent Program, is a streamlined visa pathway for highly skilled professionals to work and live permanently in Australia.

“Australia is after the brightest and best global talent to work in ten future-focused sectors. The program is designed to help grow our innovation and tech economies. This will create opportunities for Australians by transferring skills, promoting innovation, and creating jobs.”

During the current Covid19 travel and entry restrictions, successful applicants in some industry categories of this permanent visa program are fast-tracked for entry into Australia.

Work and Holiday Visa in Australia for Americans

A Working Holiday (417) visa or a Work and Holiday (462) visa allows foreigners from specific countries aged between 18 and 31 to work anywhere in Australia for one year. Countries whose citizens are currently eligible to apply for one of these visas include Canada, Israel, Italy, Spain, Hong Kong, Taiwan, and the United Kingdom. Citizens of the United States are eligible to apply for the 462 Work and Holiday visa.

The Migration Ways Consultation Process

Following are the main steps in the Migration Ways immigration/visa consultation process:

1)You contact Migration Ways by either email, phone, or website form:

In this query to us, tell us briefly about your visa, permanent residence, or citizenship need and your personal circumstances and background.

2) We will reply (mostly within 2 business days) with either some simple information that answers your query or a booking form for a paid one-hour consultation to discuss your case and options.

3) If you decide to have a paid consultation with Migration Ways, you can pay either by credit card/bank transfer via an email form or over the phone at the number above. For a one-hour consultation we charge AU$150. If you later hire Migration Ways to prepare and submit your visa/permanent residence/citizenship application, your consultation charge will be deducted from your full-service fee. At this stage of the process, also inform us which of the following communication options you prefer for your consultation: Phone, Skype, Zoom, WhatsApp.

4) After your booking is confirmed, our office will send you a time and communication option for your meeting with one of our two directors, Alberta Miculan or Rebecca Santaera.
